Welcome to Gem Minted Ltd (“Gem Minted”, “we”, “us”, “our”).
By accessing or using our website at gemminted.co.uk (the “Site”), you agree to be bound by these Terms & Conditions.
If you do not agree, you must not use the Site.
1. Marketplace Role
Gem Minted operates an online marketplace that enables independent third-party sellers (“Sellers”) to list and sell collectible items to buyers (“Buyers”).
Gem Minted does not own, inspect, store, buy, or sell any items listed on the Site.
Each transaction is a private sale contract formed directly between the Buyer and the Seller.
2. Eligibility & Accounts
You must be at least 18 years old to use the Site.
You are responsible for maintaining the accuracy of your account information and for all activity conducted under your account.
We reserve the right to suspend or terminate accounts that breach these Terms.
3. Listings & Accuracy
Sellers are responsible for ensuring that listings are accurate, complete, and not misleading.
This includes (but is not limited to):
- Correct item description
- Accurate condition
- Authenticity
- Clear photographs of the actual item for sale
Counterfeit, fake, altered, or misrepresented items are strictly prohibited and will result in account suspension or termination.
4. Orders, Payments & Fees
Payments are processed securely through third-party payment processors (e.g. Stripe).
Seller Fees
All sellers on Gem Minted are charged a flat 3% marketplace fee on the final sale price of each order.
Products over £1000 are charged a 1.5% seller fee.
Anything over £5000 are charged a 0.75% seller fee.
This fee covers:
- Use of the Gem Minted marketplace platform
- Seller tools and dashboards
- Order management and dispute mediation support
- Platform development, maintenance, and security
There are:
- No listing fees
- No subscription fees
- No hidden charges
Seller fees are automatically deducted at the time of sale.
Buyer Fees
Buyers are charged a buyer protection and payment processing fee of:
2.5% + £0.20 per order
This fee contributes towards:
- Secure payment processing via Stripe
- Fraud prevention and chargeback handling
- Buyer protection and dispute mediation where required
The buyer fee is shown clearly at checkout before payment is completed.
Fees are deducted automatically at checkout or payout stage, depending on the transaction flow.
5. Shipping & Delivery
Sellers are responsible for dispatching items within the stated handling time.
Risk of loss passes to the Buyer once the item has been dispatched, unless otherwise required by UK consumer law.
Gem Minted is not responsible for shipping delays, courier issues, or customs charges.
6. Refunds, Returns & Consumer Rights
Refunds and returns must be requested directly from the Seller.
Sellers must comply with applicable UK consumer protection laws, including the Consumer Rights Act 2015.
Gem Minted may assist with dispute mediation but is not obligated to issue refunds or replacements.
7. Disputes
Buyers and Sellers should attempt to resolve disputes directly.
Gem Minted reserves the right (but not the obligation) to intervene, suspend accounts, or restrict access where disputes indicate misuse or risk to the platform.
We reserve the right to remove your account, suspend, and hold funds should there be multiple disputes raised against you.
8. Prohibited Activities
You must not:
- Sell counterfeit or illegal items
- Harass, threaten, or abuse other users
- Manipulate prices or listings
- Attempt to bypass platform fees
- Use the Site for unlawful purposes
- List any items that you do not physically own – No Pre-sale Items.
9. Limitation of Liability
Gem Minted is not liable for:
- Item quality or authenticity
- Seller conduct
- Shipping losses or delays
- Financial losses arising from transactions
Our total liability is limited to the marketplace fees paid to us in relation to the relevant transaction.
10. Governing Law
These Terms are governed by the laws of England and Wales, and disputes shall be subject to UK courts.
